TERMS AND CONDITIONS:
The Client may check-in at any time between 15:00 and 23:00 hours. If the client wishes to check-in after 23:00 hours, he/she must inform the LESSOR before 20:00 hours on the day of arrival and a late check-in charge will be applied.
Check-out is at 11:00 a.m. on the day of departure. The Client may request a late check-out with their booking, which will be expressly accepted or refused depending on availability.
The Client accepts that his credit card will be charged the amount of 150 € as a guarantee for the rental period.
The Client accepts that if the flat is not vacated at the agreed time and if it is not vacated before 11:00 am, in the event that a late check-out has not been requested or has not been granted, additional charges will be applied to the Client's credit card, contained in the additional charges table at the end of this document. If it turns out that due to the Client's late check-out, the next booking is cancelled, the Client shall pay the cancellation costs.
The Client has received the keys of the flat to be rented. In case of loss of the keys provided, an additional charge detailed at the end of this document will be applied and in certain cases, for security reasons, the lock will be changed with the costs that this may entail.
The flat is rented for the number of guests indicated in this document. In the event that there are more people staying in the flat than the declared number of guests, the Lessor reserves the right of immediate expulsion from the flat, without refund of any amount already paid for the stay.
The flat is rented with the complete kitchen, furniture, household goods, bed linen and towels for the number of guests shown in the photographs.
The Client accepts that the flat is rented in good condition. In the event that the Client does not make any express mention of the condition at the time of rental, it is presumed to be in good condition.
The Client undertakes to make good use of the rented flat and undertakes to hold the Lessor harmless from any improper action.
The Client undertakes to respect the Community rules of the building where the flat is located and to use the communal areas correctly.
The Client undertakes to observe the rule of silence from 22:00 hours until 9:00 hours the following morning, being able to make the usual noises of an inhabited dwelling, without disturbing the neighbours of the property. Each flat has a decibel monitor that notifies the Lessor in the event of causing noise that exceeds the legal decibels allowed at those hours. The decibel monitor only monitors the noise that is produced in the flat, without the voices being recorded.
It is strictly forbidden to have parties in the flat.
Smoking is strictly forbidden in the flat.
Pets are not allowed in the flat.
In case of damage and/or disappearance of any furniture, household goods, bed linen and/or towels, additional charges will be applied to repair and/or replace what has been damaged.
Failure to comply with the rules of the flat regarding silence, prohibition of parties, prohibition of smoking and prohibition of keeping animals, will result in immediate expulsion from the flat without refund of the guarantee and the application of additional charges detailed in the table at the end of this document.
The Client will be responsible for any damage caused by third parties to the flat during their stay.
The Client shall be liable for any damage he/she may cause to third parties or third parties' property during the rental period.
The Client must treat the Lessor's employees with respect. Failure to do so may result in expulsion from the flat, without refund of any amount paid for the stay.
The Client will be responsible for all fines, charges and/or administrative and/or legal sanctions that may be incurred during the rental period. In the event that the Lessor is notified of any such penalties, the Client agrees to pay such penalties and authorises the Lessor to charge the corresponding amount to the Client's credit card. In the event that the Lessor is not charged and the Lessor is penalised, the Lessor shall be entitled to reimburse the Customer by means of any legal action that protects its rights.
In accordance with Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights (LOPD), the personal data supplied by the Client will be incorporated into an automated file, owned by the Lessor. Your data will be treated with absolute confidentiality and will only be used to provide the service detailed herein and to issue the corresponding invoice. In compliance with the provisions of the LOPD, the Client may exercise their rights of access, rectification, cancellation and opposition of data by writing to the Lessor's e-mail address: kiwipisos@gmail.com.
This contract and its clauses have been drawn up in accordance with the Law in force and Spanish Law and Jurisdiction shall be applicable. The Parties agree to submit any dispute arising from the execution or interpretation of this document to the Courts and Tribunals of the city of Donostia - San Sebastián, given that this is the place where the flat is rented and the property is located, expressly waiving their own jurisdiction, should any other jurisdiction be applicable.

**Articles 15 and 16 of Law 13/2016, of 28 July, on Tourism are applicable and are transcribed below:
Article 15.- Right of access to establishments. 1.- The establishments are considered public premises, and access to them may not be restricted for reasons of race, sex, religion, opinion, disability or any other personal or social circumstance that entails discrimination. The accessibility conditions shall be those determined by the regulations applicable to each type of establishment. Access to and stay in the establishments may be conditional upon compliance with the regulations of use or internal regime. These regulations may not contravene, under any circumstances, the provisions of this law and must be posted in a clearly visible manner in the places of access to the establishment. 2.- The owners of tourism businesses or establishments may prevent those who fail to comply with any of the duties established in the following article from staying in their facilities. 3.- The owners of tourism businesses and establishments can request the assistance of police officers to evict people who disturb public order or who behave violently or aggressively from an establishment. 4.- The rules governing the admission of pets in a tourist accommodation establishment must be stated in visible places in the establishment and in the promotional information. In any case, in accordance with the provisions of the sectorial regulations, people with total or partial visual impairment must be able to enter the establishment accompanied by guide or assistance dogs.
Article 16.- Duties of tourist users. For the purposes of this law, and without prejudice to the provisions of other applicable legislation, the users of tourist services have the obligation to: a) Respect the rules of use or internal regime of the establishments and the particular rules of the places visited and of the tourist activities.
b) Observe the rules of hygiene, education, social coexistence, dress and respect for people, institutions and customs for the proper use of the different tourist services.
c) To pay the price of the service contracted at the time of presentation of the invoice or, where appropriate, in the place, time and manner agreed, and in no case shall the formulation of a complaint or claim exempt from the obligation to pay, unless previously agreed.
d) To respect the environment, the historical and cultural heritage and the tourist resources of the Basque Country.
e) To respect the facilities and equipment of tourism companies and establishments.
f) To comply with the booking system in accordance with the provisions of the applicable regulations and, in the case of the provision of accommodation services, to respect the agreed date of departure, leaving the occupied unit free.
g) To treat with respect and dignity the people who work in the development of the tourist activity.
h) Not to transfer their right to use the contracted services to third parties, unless this is permitted by law or provided for in the contract.
